Looking to move to PC from console gaming. I am new to pc so plase be gentle.

spec would be for all round gaming without needing to be replaced any time soon.

It may be beneficial to choose an AMD platform over Intel.

Budget is between 2500-3000 including monitor.
As for games primarily FPS and RPG but anything really.
would the AMD be better performance wise or price

Vs the 9700k, they're pretty much equal for performance (literally talking a couple of FPS on intels side) but AMD is significantly cheaper, but for futureproofing and feature set, plus less security issues and therefor less software mitigations to safeguard them, AMD is the way to go. They're on a newer motherboard platform that supports new M2 SSD's that are an awful lot faster, faster RAM, much better VRM cooling capabilities on the boards which should lead to longer lifespan.

I'm very biased, I've not been a fan of Intel since their 7th Gen debacle when I started taking serious consideration of their dubious business practices. Similarly I wasn't a fan of AMD as a serious competitor until this Zen 2 release.

Intel are stuck on 12nm and all they can do it add more cores at the expense of heat and thermal throttling. Sure, they eeek one or two frames performance but at a serious cost and the security restrictions which are being found by the dozen are meaning that board partners and Microsoft are constantly having to patch their awful chips which results in gimped performance. IMHO, the performance you get out of any high end Intel chip now, will not be the same performance you get out of it within 2 years. Their original performance has already been restricted by about 20%. It's just very very shoddy.

AMD are not just producing good stuff now but are listening to people, if you go over to the Phoronix site you will see they have fixed a few Linux problems very quickly.

From a user perspective I hope AMD stay on track and that that forces Intel to do something worth while, we could do with some competition as that has benefits all round.

Fully agreed. AMD have really learnt from their sink into uncompetitiveness and driver woes. Their driver support is definitely equaling nVidia in the GPU space, and often far quicker to react. Their feature additions on their GPU's is really quite interesting as well. In the CPU space, they fully deserve a place at the top for a few years, I think they've done remarkably well with such a come back in a relatively short space of time, and over the last generation, the improvements were simply stunning.
