Just been looking in the box that the ultranote ii came in after buying it in August as only briefly looked when first unpacked and noticed the windows 10 disc so left it in there and just checked the box tonight.

I noticed the windows 10 disc was a "recovery" disc not the original disc as stated in the title to this thread. I've sent an email to PCS asking about this as there is no product key stuck under the case of the laptop either or anything inside the box.

Not sure if this is normal practice and what does one do should I need to format the laptop?

My desktop was windows 8.1 same with my laptop I did the upgrade to 10 then formatted and did a clean install and haven't needed a product key I can only assume the bios is locked with the Key and MS severs as done a clean install since the last one and it never asked for a key "skpped" and it has activated fine.

However I would assume I should still have a Genuine Windows 10 Home 64 Bit - inc DVD & License that I paid £79 for during the purchase of the laptop?

Hi, have you double checked your order because if you had ordered Windows 10 then that would have been installed on your laptop by PCS not Windows 8.1.

Yeah on the order screen I ordered windows 10 home edition £79.....I have just got an email back from PCS and this is what they have said.

Your recovery disk is marked as such by contract with Microsoft due to being an OEM provided disk, it does in fact contain a full copy of windows 8.1 for recovery or reinstallation should the need arise.

The product key would be injected into your motherboard BIOS. There should be no need to access this and the activation would be automatic shortly after receipt of the item.

This is what is says on my order form

Operating System Genuine Windows 10 Home 64 Bit - inc DVD & Licence
Windows 10 Upgrade FREE Upgrade to Windows 10 with all Windows 7 & Windows 8.1 Purchases*
DVD Recovery Media Windows 10 (64-bit) DVD with paper sleeve

So firstly they sold me Windows 10 for £79 I didn't pay for 8.1 with free upgrade to windows 10

secondly - it is fraud selling a genuine windows product then only supplying a recovery disc should I need to format and reinstall.

3rd - In the email they have told me that windows 8.1 is supplied on the disc should I ever need to format although the disc does say "windows 10 recovery disc" at the time of writing this email I haven't had the chance to check and will later to see what is actually on the disc but I did pay for windows 10.

So it looks like I might have take this further. trading standards first port of call

Sorry fear I've just re-read your post the laptop does have windows 10 and came with windows 10 (wifes laptop) I was talking about my laptop and desktop that I upgraded them to 10 from 8.1 and didn't need the product key when I installed windows 10 and assumed because the wifes laptop didn't have a product key when the laptop came then it must by like my pc's the key is in the bios

That's the usual situation now, the activation keys are in the BIOS, the stickers are no longer needed. If you reinstall Windows it's activated automatically.

Indeed that does sound like a screw-up somewhere. You appear to have paid for a Windows 10 installation DVD, yet what you have is a Windows 8.1 installation DVD with the possibility of a free upgrade. On the face of it that's not what you paid for. I would call PCS (don't email) and get to the bottom of what you actually paid for and what was delivered to you.

That all said, you actually haven't lost out on anything. You can easily run the Windows 10 Media Creation tool (even from within Windows 10) and download a Windows 10 disk image that you can burn to a DVD. Then you will have an installation DVD for Windows 10. That's how I installed Windows 10 from my existing Windows 8.1 system. Once Windows 10 has been activated the Microsoft activation servers remember that this device has an active Windows 10 license. So you've not actually suffered any loss, you can either download Windows 10 for free now and make an installation disk, or you can reinstall Windows 8.1 and then download Windows 10 using that and make a Windows 10 installation disk.

It's very hard to prove fraud when you have suffered no material loss.

secondly - it is fraud selling a genuine windows product then only supplying a recovery disc should I need to format and reinstall.

No it's not. With OEM licensed versions of Windows, which is always what you get when you buy any computer pre-installed with Windows, you get a recovery disk which can be used to restore your computer to it's factory condition - which means you get back to the installed system you bought. You don't typically get a Microsoft Windows installation disk - from any computer vendor.

3rd - In the email they have told me that windows 8.1 is supplied on the disc should I ever need to format although the disc does say "windows 10 recovery disc" at the time of writing this email I haven't had the chance to check and will later to see what is actually on the disc but I did pay for windows 10.

Again, there seems to be some confusion on what it was that you actually bought and you can only clear that up by calling PCS and speaking to them one-to-one. It may be that a mistake has been made at PCS (everyone makes mistakes sometimes) or it may be that there was a misunderstanding over what was ordered and what was supplied. Only a call to PCS can sort this out

So it looks like I might have take this further. trading standards first port of call

They won't be interested until and unless you have exhausted all avenues open to you to resolve this with PCS. All you have done so far is to email them, you need to call them and sort this out. In any case, as I mentioned earlier, you have suffered no material loss. Even with a Windows 8.1 installation disk you have a free upgrade to Windows 10 available to you, at least until August 2016.
